End User License Agreement (EULA) for Browser Operator

Version 1.0, Effective April 16, 2025

IMPORTANT – READ CAREFULLY:

This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and Tyson K Thomas ("Licensor") for the use of Browser Operator ("Software"), which is built upon and incorporates portions of the open-source Chromium project.

By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.

0. Definitions

The following terms, when capitalized in this Agreement, have the meanings assigned to them below:

Licensor grants you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the Software on a personal device for testing and evaluation purposes only, subject to the terms of this Agreement. This license is valid for a period of one (1) week from the date of installation, after which it will automatically expire unless extended by Licensor.

3. Ownership and Open Source Acknowledgment

The Software incorporates and depends upon components of the Chromium project, which is a free and open-source software project. The Google-authored portion of Chromium is licensed under the 3-clause BSD license.

Chromium also includes third-party components that are subject to a variety of open-source licenses, including but not limited to the MIT License, GNU Lesser General Public License (LGPL), Microsoft Public License (Ms-PL), and the Mozilla/GNU/MPL-GPL-LGPL tri-license.

4. Privacy Policy

The Software may collect non-personal usage data, such as crash reports, performance metrics, and diagnostic logs, solely for the purpose of improving the Software during early access testing. We may also process certain data visible in the browser user interface (UI) in order to provide the functionality of the Software. For a complete description of our data practices, please see Section 12 (Privacy Policy) below.

While we do not intentionally collect personally identifiable information (PII), there is a possibility that data input by users or displayed in the UI (e.g., names, email addresses, or other identifying information) could inadvertently be transmitted to the OpenAI API and Anthropic API as part of the language processing services.

Proof of Concept Disclaimer

This Software is provided as a proof of concept (PoC) for early access testing purposes. It is not intended or designed for use in critical, sensitive, or mission-dependent tasks. You should not rely on the Software for any application that involves significant risk to the user, third parties, or infrastructure, including but not limited to financial transactions, healthcare, legal decisions, or safety-critical systems.

The Software is being provided "as is" and may contain errors, bugs, or limitations. By using the Software, you acknowledge that it is experimental and that any data or results produced by the Software may be inaccurate, incomplete, or unreliable. Use of the Software for critical or sensitive tasks is strictly discouraged.

OpenAI's Data Usage:

OpenAI processes your data in accordance with their Privacy Policy, which you can review at: OpenAI Privacy Policy.

OpenAI may store and use data to improve its models, and may process the content provided through the Software, which could include user inputs or any data visible in the browser UI. We do not share or sell your data to third parties. Any data sent to OpenAI is processed for the purpose of providing services and improving their models.

Anthropic's Data Usage:

Anthropic processes your data in accordance with their Privacy Policy, which you can review at: Anthropic Privacy Policy.

Anthropic may collect data for the purpose of improving their models, which may include storing the inputs and outputs of interactions, but they commit to not sharing or selling data for advertising purposes. Any data sent to Anthropic is processed solely for the purpose of providing services and improving their models.

Browser UI Data Processing:

Any data that is visible in the browser UI (such as text entered into fields, displayed responses, or other interactions) may be processed by OpenAI and Anthropic to generate responses or complete the service you are interacting with. This data may include content that could be interpreted as personally identifiable information (PII) if provided by the user. However, we do not intentionally collect PII unless explicitly provided by you.

We do not collect, store, or share data from your browser UI for any purpose other than the processing required for the service. However, you should be aware that PII could be processed by OpenAI or Anthropic if it is input by the user during interactions.

5. Data Protection

While using the Software primarily for testing purposes, we are committed to respecting applicable data protection laws, including but not limited to the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), where applicable.

International Data Transfers

Your data may be transferred to and processed in countries outside your country of residence, including the United States, where OpenAI and Anthropic are headquartered. These countries may have different data protection laws. By using the Software, you consent to these international data transfers as required for providing the service.

Children's Data

This Software is not intended for users under the age of 16. If you are under 16 years of age, please do not use or access the Software at any time or in any manner. If we learn that PII has been collected from persons under 16 years of age, we will take appropriate steps to delete this information.

Logging and Data Retention

Crash reports, diagnostic logs, and performance metrics are retained for up to 30 days after collection, after which they are permanently deleted. We do not retain or control the data once it has been processed by OpenAI or Anthropic APIs. Any locally stored logs are automatically deleted when the Software is uninstalled.

6. Disclaimer of Warranty

The Software is provided "AS IS" without warranty of any kind. To the maximum extent permitted by applicable law, Licensor disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

In no event shall Licensor be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of the use of or inability to use the Software, even if Licensor has been advised of the possibility of such damages.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law principles. Any legal action or proceeding relating to this Agreement shall be brought exclusively in the courts of Washington State.

9. Entire Agreement

This Agreement constitutes the entire agreement between you and Licensor concerning the Software and supersedes all prior or contemporaneous communications.

10. Confidentiality (Early Access NDA Clause)

By installing or using this early access version of the Software, you acknowledge and agree that the Software and any related communications, documentation, features, or interfaces constitute proprietary and confidential information (“Confidential Information”).

This confidentiality obligation survives the termination of this Agreement and remains in effect until the Confidential Information becomes public through authorized means.

11. Changes to This Agreement

We may update this Agreement, including the Privacy Policy and Confidentiality provisions, from time to time. The updated version will be posted, and the effective date will be revised. Please check for updates regularly.

Consent Mechanism

By clicking "I Agree" during the Software installation process, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement and the Privacy Policy. Installation of the Software constitutes acceptance of these terms. If you do not agree to these terms, you must not install or use the Software.

13. Severability

If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable.

14. Export Control

You agree not to export or re-export the Software except in compliance with United States export laws and the laws of the jurisdiction in which the Software was obtained. You represent and warrant that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods, or listed on any U.S. government list of prohibited or restricted parties.
